  • Legal framework of Section 403 CrPC
  • Prohibitions against successive trials for the same offense
  • Judicial interpretation and case law precedents
  • Exceptions and limitations to the doctrine of double jeopardy

Excerpt from the Book

RULE OF DOUBLE JEOPARDY UNDER SECTION 403 CrPC

Section 403 Cr.P.C contemplates a situation where a person has once been tried by a court of competent jurisdiction and acquitted or convicted by such court, he/she cannot be tried again for the same offence or for any other offence based on similar facts. The Hon'ble Supreme Court of Pakistan has interpreted this rule by observing in case Syed Alamdar Hussain Shah v. Abdul Baseer Qureshi & two others. It was held that where the prosecution finally concluded ended either in acquittal or conviction that a fresh prosecution for the same would be barred.

Summary of Chapters

1. INTRODUCTION: Outlines the fundamental principle that no person should be punished more than once for the same offense and emphasizes the importance of this rule in protecting the integrity of the criminal justice system.

2. RELEVANT PROVISIONS: Lists the essential legal statutes and constitutional articles that support the protection against double jeopardy, including references to the Constitution of Pakistan and the General Clauses Act.

3. MEANING OF DOUBLE JEOPARDY: Defines double jeopardy as a defense against a criminal prosecution, essentially meaning "trial for the same offence".

4. MEANING OF CONVICTION & ACQUITTAL: Clarifies the legal definitions of conviction and acquittal to establish the basis for invoking the protection under Section 403.

5. RULE OF DOUBLE JEOPARDY UNDER SECTION 403 CrPC: Explains the core mandate of Section 403, stating that once a person has been tried by a competent court, they cannot be retried for the same facts.

6. BASIS OF SECTION 403 CrPC: Discusses the ancient legal maxim "Nemo debet bis vexari pro una et eadem causa" and its embodiment in Pakistani law.

7. CONDITIONS: Outlines the necessary criteria that must be met to successfully bar a trial, focusing on the competency of the court and the finality of the prior judgment.

8. PROVISIONS OF LAW: Details the specific scenarios under which a person is protected from subsequent trials, categorized by the nature of the offenses and the underlying facts.

9. EXCEPTIONS TO SECTION 403/RULE OF JEOPARDY: Identifies specific instances where the protection does not apply, such as separate offenses, departmental inquiries, and instances of continuing offenses.

10. RULE OF ESTOPPEL OR PUBLIC POLICY: Analyzes the philosophical basis of the doctrine, arguing it rests on public policy rather than strictly on the doctrine of estoppel.

11. WHAT TIME TO TAKE PLEA: Defines the appropriate procedural timing for an accused to raise a plea based on the bar of Section 403.

12.CONCLUSION: Reaffirms that the principle serves to protect human dignity and prevent endless, burdensome litigation in the judicial system.
