In the United States of America, there are different laws governing LGBT rights as far as the jurisdiction of the respective states are concerned, most notably in terms of adoption and employment. There are certain spheres in some states where discriminatory approach is undertaken LGBT people are still prevalent.

The decriminalization of sexual activities between people belonging to the same gender was facilitated through the judgment of the Supreme Court of the United States in the case of Lawrence v Texas. In this case, the restriction of sexual activities between adults who belonged to the same gender was held to be in violation of the Constitution of the United States of America. The decision of the Supreme Court of the United States in the case of Roe v Wade was taken into consideration in terms of right to privacy. As a result, law related to sodomy in the state of Texas was abolished. It led to the legitimisation of homosexual acts in each and every state of the United States of America. The decision of the Supreme Court of the United States in the case of Bowers v Hardwick to uphold the constitutional status of a statute in Georgia with reference to homosexual acts being criminal was also reversed in the case of Lawrence v Texas. It resulted in the lifting of restrictions imposed upon the scope of liberty as understood by the Due Process Clause under the purview of 14th Amendment of the Constitution of the United States of America.
