1. The simultaneous application of Human Rights Law and International Humanitarian Law to armed conflicts

There have been many questions as to the scope, conditions and limitations of this area in recent years with regard to the application of human rights law and international humanitarian law. Indeed, the concurrent application of HRL and IHL is possible under certain conditions, starting from the fact that IHL is a set of rules of law applicable to armed conflicts; therefore, their existence is the main factor for the co-operative application of IHL and HRL.

Although there is no clear reference to the elements necessary to declare a situation an armed conflict, IHL applies to armed conflicts, which are divided into international and non-international ones, but also to periods of military occupation (Common Article 2 of the Geneva Convention and Additional Protocol I). In the opinion of the International Criminal Tribunal for the former Yugoslavia, there is an armed conflict whenever states shift from using force with each other to a more active use of force, but no explicit reference has been made to the criteria on which a situation can be regarded as an armed conflict. Although the number of deceased and the duration of the conflict do not affect the application of IHL, the concept of low-intensity conflict is a matter of concern. In any event, IHL will apply whenever an armed conflict is detected, and will be accompanied by HRL.
