Women were deprived of every right and were not allowed to speak, when we take a look at the revolutionary year of 1848 or the era of the Frankfurt National Assembly women were not allowed to give their opinions, they were suppressed and during any assembly session they used to sit backstages and they were deprived of their right to vote, even in today’s era women are looked upon as a liability and curse, It's disheartening to see woman being consistently mistreated. A woman have always been looked upon as a maid. and she was considered to be enslaved by men and she always endured the misogynist taunts and vapid violence, This abstract highlights the urgent need to address these injustices and advocate for reforms that ensure gender equality within legal frameworks. By examining the dynamics of injustice faced by women, we aim to underscore the imperative of dismantling systemic barriers and advancing principles of equity and fairness in the pursuit of justice.

During an earlier period, women were given a status equal to men; they are indeed equal, but after a passage of time, she was considered as curse, liability, and burden. Her rights were snatched in such a way that she was not allowed to speak or give her opinion; As per the Indian context, there were some rituals like Sati Pratha, where a widow sacrificed herself by sitting atop her deceased husband's funeral pyre, (Raja Ram Mohan Roy was the first person who raised his voice against Sati Pratha). Women were subjected to much more sacrificial rituals, they were exchanged as a token bribe price or given to a priest as a gift during a religious sacrifice. Even a judgment was made on the discrimination of woman, in Madhu Kishwar v. State of Bihar, the court said that "half of the indian population are women. Women have always been discriminated against and have suffered discrimination in silence. Self-denial and their nobility and fortitude, and yet they have been subjected to all inequities, indignities, inequality, and discrimination." The purpose of addressing the Indian historic context as well as a legal statement here was to highlight that women everywhere were subjected either to sacrifice or regarded as a liability or burden. The matter here is that gender equality, as an ideal, has always eluded the constitutional provisions of equality before law or equal protection of law. This is because equality is always supposed to be between equals, and since the judge didn't concede that men and women were equal, gender equality did not seem to them to be a legally forbidden inequality; in Bradwell v. State of Illinois, Justice Bradley of the United States Supreme Court said, "The natural and proper timidity and delicacy that belong to female sex evidently unfits it for many of the occupations of civil life. The paramount destiny and mission of women are to fulfill the noble and benign offices of wife and mother. This is the law of the creator."
