Online communication is a trend in modern era due to the easy access and low cost. Through the trendy devices like computers, mobile phones and devices, Internet can be accessed neglecting the places and time. As the increasing number of users, there is another world appear online which are virtual. People nowadays spend times and labour in the virtual world rank virtual property to be most important because this directly influence the way they communicate. Also, the presence of electronic money systems changed the consumption pattern, as they are not using contact transfer, in order to facilitate easy payment and give the payee more confidence.Yet, actual property is being ignored is a trend as well when people shifted their main interest on the net. Online activity changes communication and self-disclosure too[1]. People’s values are different and they may have transfer from actual property to virtual property in order to ease their daily life.
According to Duranske, virtual property can be so easily bought and sold. It is no less “real” then a digital book and downloadable computer program, which are also, at their core, merely ones and zeros.[2] And this is the truth because they are made up digitally that we cannot touch and feel but viewing it through digital mediums. However, virtual properties meant something to the user despite its presence are only in virtual world. According to Nelmark,“virtual property” as any property interest that is both intangible and exclusionary[3]. That’s why many cases reflected there is increasing significance in virtual property.
The functions of virtual property are mostly to add more interesting factors in virtual world and imitate how the system runs in real life. Some virtual world provided loan and grant of virtual money featured with rates and discounts. There are virtual companies courting their business, and some of them are listed on virtual stock exchanges where their shares are bought and sold by avatars with "Linden Dollars" and other virtual currencies[4]. Virtual property within these virtual worlds provides the incentive for players to participate, and to continue to participate, in virtual worlds[5].
There are proliferation on the focus and attentions put on virtual property and their protections. Dacheng Law Firm's senior lawyer Shi-Jie Liu recently told reporters that the protection of virtual property has four major problems: 1.cannot controls the price of virtual goods; 2.virtual goods transactions violated tax laws; 3. loss of virtual items is difficult to ascertain; 4.the virtual goods of wealth cannot be recovered.[6] The above mentions lead to problems as it directly influences the actual property of virtual property owners. Officers need to put an eye closely monitoring the trend as it costs illegal activities often thus conflicts occurs. There are cases around the world proved that virtual property is in an increasing trend of gaining attention.
In December 2003, a Beijing court ruled in favour of Lu Hongchen who had spent 2 years and more than a thousand dollars playing the online game Red Moon before a hacker got into the system and removed his virtual money and virtual weapons[7] . Finally, Mr. Lu won because the court claimed that virtual goods had been acquired using Mr. Lu’s labour, time, cash and wisdom they therefore belonged to him. He was awarded US $1200 in real cash for his virtual time. This particular cases can proved that virtual property had real life value, and this is measured by the time used to acquire the virtual goods. Although it is difficult to control the price of virtual items,[8] there are still ways in weighting as long as the owner contributed. Virtual goods and properties are no longer imagination but it can turn to real cash in hand.
