Murder is a penal act that erases all life functions of the person, it is the most serious crime committed against this inalienable and essential right.
Traditional Albanian Law that is identified with Canon, and mainly with Canon of Leka, it’s very important to be treated in relation with murder. In this project, I will treat the Aggravated murder topic based on three main canons applied throughout Albanian areas as: Canon of Leke Dukagjini-North, Canon of Skenderbeu-Mid and Canon of Laberia-South of Albanian populated areas.
The vast importance to treat Aggravated murders based on Canon stands that often is rumored that ‘it is reacted based on Canon’ but the truth is different. Often people for their benefits, often financial benefit, often called upon respecting the moral, manhood of their family and relatives, and respecting the rules of the Canon, they have misused the norms-rules of the Canon and adopt it to their needs.
The Canons have harshly condemned the murder. As the institution for the blood revenge against the perpetrator, his family and relatives existed, at the same time was established the institute for forgiveness as a solid ground for Murder prevention and as a solution to stop the revenge that could last forever and for generations.
I believe that this modest seminar will be beneficial to those dealing with different legal, social and other fields of the studies.

Objectives and Research Scope

This work examines the concept of aggravated murder as defined and regulated within traditional Albanian legal codes, specifically the Canons of Leke Dukagjini, Skënderbeu, and Labëria. The research aims to clarify how these customary laws historically managed homicide, blood revenge, and social sanctions, while highlighting how they are frequently misinterpreted or misused in modern contexts.

  • Analysis of the historical and social foundations of traditional Albanian Canons.
  • Comparative examination of aggravated murder definitions across three major Canons.
  • Evaluation of sanctioning mechanisms and the role of forgiveness in blood feuds.
  • Distinction between traditional customary law and contemporary criminal justice applications.

Excerpt from the Book

1. ALBANIAN’S CANONS

Even before the state was estabilished, the society harshly acted against murderers. The society has acted with its most radical measures against those ‘outlaws’ who took lives.

Historically, murder is known on Hamurabi law, 28th century BC- (Persia), at Manu Laws (India)- 1100-1200, 12 tables (Roma)- 450 BC, at medieval Albanian canons, Canon of Leke Dukagjini, Canon of Skenderbeu, Canon of Laberia, etc.1

The reaction of the society towards murders, depending on the time we speak, was done in different manners and specific manners. In this period, the sentence had one aim “to cause physical suffering to the murderer”2.

Since the unorganized societies, on the most primitive societies, the most common sentence was “eviction or outlawing the murderer from the society, revenge, compensations or blood requital”3.

Are there cases where traditional Canons mandate or allow revenge?

Yes, the Canons recognize the principle of blood revenge under strict, prescribed conditions. However, the author emphasizes that the system was designed with "institutes for forgiveness" intended to stop the cycle of violence from lasting across generations.
