For Irland’s history of newspapers and magazines the year 2008 will always remain a milestone. On January 1st the so-called Press Council and Press Ombudsman was inserted. This establishment stands for a very important development for the press industry. Acting Press Ombudsman is Professor John Horgan, who was elected on 14 August 2007 by the Press Council. Having a background in Journalism and Politics as Professor of Journalism at Dublin City University and being a member of the Irish Parliament he is now operating with the responsibility in the first press appeal mechanism that is free from the outside in the history if Ireland. Whether this establishment brings advantages or disadvantages for both the people and the media is a quite interesting question. In the following I will mostly elucidate the Press Council in relation to privacy. For this purpose I am going to discuss the possible strengths or weaknesses of this new appendage.

3 Strengths and weaknesses of the new institutions

The most important strength of a system with the goal to defend the privacy of people in the press would be the total independence from the press. According to the Press Council of Ireland (2007), both the Press Ombudsman and the Press Council are independent from Government and in accomplishment independent from the media. Furthermore he defines: "Independent press regulation is the most objective, credible and transparent form of press regulation." (Press Council of Ireland, 2007, p.1) The newspaper, periodical editors, and journalists cooperate with each other. On this account the Press regulation can work best. This system of cooperation only works because the editors and journalists signed up to the Code of Practice. Their signature under this contract means they pledge to abide to those journalistic principles. (Press Council of Ireland, 2007, p.1)

The already mentioned Code of Practice is another important part of Privacy law and affects both the journalists and Press Ombudsman. Before inserting the Code of Practice no constitutional right to privacy existed or was part of the Irish Constitution in any term. (Clark, 1990, p.6) The Code of Practice represents important rights and rules for both the press and the people. Therefore it assures safety for both sides and can be seen as a big strength that came up with the Press Council and Press Ombudsman. The Press Council of Ireland (17.11.2011) comments: "It is the duty of the Press Ombudsman and Press Council of Ireland to ensure that it is honoured in the spirit as well as in the letter, and it is the duty of publications to assist them in that task." (Code of Practice)
